A Mark Is a Legal Declaration, Not a Sticker
Every symbol printed on a product label represents a claim to a market's authorities that the product meets that market's requirements, and that you hold the evidence to prove it. Affixing one without the underlying file is not a paperwork shortcut; it is a false declaration, and the enforcement consequences run from a customs hold to a mandatory recall to a personal liability for the responsible officer.
US manufacturers hit this the first time a European distributor asks for a Declaration of Conformity, or a container is held because the label lacks an importer address. By then the design is frozen and testing takes months. Map the markings during requirements definition, while a design change is still cheap.
What Sits Behind Each Mark
CE (European Economic Area). Not a quality mark and not issued by anyone. It is the manufacturer's own declaration that the product complies with every applicable EU directive or regulation. Which ones apply depends on the product: the Low Voltage Directive for mains equipment, the EMC Directive for anything electrical, the Radio Equipment Directive for a transmitter, the Machinery Regulation, the Toy Safety Directive, RoHS for substance restrictions, REACH for chemicals. For most consumer electronics you self-declare after testing to harmonized standards; higher-risk categories require a Notified Body. UKCA (Great Britain). Structurally parallel to CE with its own designated standards and its own approved bodies. Great Britain has repeatedly extended recognition of CE marking for many product categories, but the recognition is category-specific and has changed more than once, so verify the current position for your exact product rather than assuming. Northern Ireland follows a different arrangement again.
FCC (United States). Mandatory for anything that emits radio frequency energy, which includes both intentional radiators such as Wi-Fi and Bluetooth modules and unintentional radiators such as any device with a digital clock above 9 kHz. Intentional radiators require certification through a Telecommunication Certification Body and get an FCC ID; most unintentional radiators use the Supplier's Declaration of Conformity route. UL, ETL, CSA (North America). Not government marks. They are Nationally Recognized Testing Laboratory listings, and while federal law rarely mandates them, electrical codes, insurers, retailers, and OSHA workplace rules make them commercially compulsory for most powered products. Other markets. Canada requires ISED certification for radios and CSA or equivalent for electrical safety, plus bilingual labeling. Australia and New Zealand use the RCM mark. Japan uses PSE for electrical products and the giteki mark for radio; Korea uses KC. Each is a separate submission with separate fees, and none accepts a CE file as-is, though most accept the underlying IEC test reports through the CB Scheme.
The Testing Behind the Marks
Almost every regime tests the same four things with different acceptance criteria and report formats.
- Electrical safety. Dielectric withstand, leakage current, creepage and clearance distances, temperature rise under fault conditions, and abnormal operation testing. The base standards are usually IEC 62368-1 for information and audio-video equipment or IEC 60335 for household appliances.
- Electromagnetic compatibility. Radiated and conducted emissions plus immunity to ESD, surge, and RF fields. Emissions failures are common on the first attempt, and the budget realities are described in EMC testing cost.
- Radio. Transmit power, occupied bandwidth, spurious emissions, and for Europe, receiver performance and RF exposure. Using a pre-certified module cuts this dramatically but does not eliminate it, because the host still needs testing and the module's certification only carries over if you follow its integration rules exactly.
- Substances and materials. RoHS elemental testing, REACH SVHC screening, phthalates and heavy metals for children's products, and food-contact migration where relevant.
Lithium batteries add a mandatory layer independent of any market mark: UN 38.3 transport testing must be complete before the product ships anywhere by air or sea, as covered in UN 38.3 testing.
What It Costs and How Long It Takes
Rough working numbers for a small connected consumer product, assuming it passes the first time:
- EMC emissions and immunity: $6,000 to $18,000, 2 to 4 weeks of lab time.
- Electrical safety to IEC 62368-1: $8,000 to $25,000, 4 to 10 weeks.
- FCC certification with an integrated radio: $5,000 to $15,000; substantially less with a pre-certified module.
- Radio Equipment Directive testing for Europe: $8,000 to $20,000.
- RoHS and REACH testing: $1,000 to $4,000 depending on the number of distinct materials.
- UL listing including the initial factory inspection: $15,000 to $60,000, plus recurring quarterly inspection fees.
A realistic all-in figure for entering the US and Europe together is $40,000 to $120,000 and 4 to 8 months, and first-attempt failures are common, each retest adding lab fees plus a design cycle. Work out which certifications a new electronic product actually needs before committing to a launch date.
The Technical File
The mark is the visible part; the technical file is what a market surveillance authority actually asks for, typically within days of a request. Keep it assembled rather than reconstructing it under pressure: product description and variants, drawings and schematics, the bill of materials with component certificates, the standards applied, all test reports, the risk assessment, manual and label artwork in the required languages, and the signed Declaration of Conformity.
Retention is typically ten years from the last unit placed on the market. Change a component, particularly a power supply, an antenna, or a housing material, and the file must be updated and the change assessed for whether it invalidates a test report.
Europe also requires named parties on the product or packaging: the manufacturer's name and address, and an EU-based importer or authorized representative. A US company selling direct to European consumers still needs a responsible person established in the EU, and that role carries real obligations.
Three Mistakes That Keep Repeating
Assuming the factory handles it. A contract manufacturer's existing certificate covers its product, not yours. Unless your company is named on the certificate as the manufacturer, you have nothing. Ask to see the actual certificate and check the model numbers.
Treating the mark as a late-stage task. Creepage distances, enclosure flammability ratings, antenna keep-out zones, and accessible-part temperature limits are geometry and material decisions. Discovering them after tooling means new tooling.
Marking for markets you are not selling into. Printing CE on a product sold only in the US, because it looks official, is a false declaration with no upside. Mark for the markets in your plan, and add marks as you add markets, which is another argument for the focused approach in choosing your first international market.
