The short answer

Most consumer and industrial products in the United States are not "approved" by any government agency before they go on sale — the manufacturer self-certifies compliance with the applicable safety and emissions standards and keeps the evidence on file. Only a limited set of categories require pre-market authorization. The question you actually need to answer in week one is which of three buckets you fall into, because the answer changes your schedule and budget more than almost any engineering decision.

The three regulatory buckets

  • Pre-market authorization required. A federal agency must review and permit your product before you may market it. Medical devices, drugs, aircraft, motor vehicles, and radio transmitters live here. Months to years, and the pathway drives the design.
  • Mandatory testing and certification, no agency review. Children's products, for example, must be tested by an accepted third-party lab against specific standards, but nobody issues you a permit. Weeks to months.
  • Self-declared compliance. The largest bucket. You determine which standards apply, test to them, label correctly, and retain documentation. Enforcement is after the fact, and it is real.

A fourth, quietly important layer sits outside government entirely: retailers and marketplaces impose their own documentation requirements, and a major retail buyer or online marketplace listing can demand test reports that no law strictly requires.

The categories that should make you stop and check

  • Anything with a medical intended use. A claim to diagnose, monitor, treat, or rehabilitate can place your product under FDA device regulation — even if the hardware is a commodity sensor. Start with is my product a medical device.
  • Anything that transmits radio. Wi-Fi, Bluetooth, cellular, sub-GHz, or a custom transmitter requires FCC equipment authorization before marketing. This one genuinely is pre-market — see FCC certification for electronics.
  • Mains-powered electrical products. No federal approval, but the practical market requirement is a mark from a nationally recognized testing laboratory. Retailers, insurers, and local electrical inspectors will ask.
  • Children's products. Federal law requires third-party testing to specific standards, plus tracking labels and a certificate. Details in CPSIA requirements for children's products.
  • Food or skin contact. Materials must be suitable and, for food contact, permitted for the use — see food-grade plastics.
  • Lithium batteries. Transport testing is required before your product can legally ship by air or sea, independent of anything else — see UN 38.3 lithium battery testing.
  • Pressure, gas, fuel, flame, or chemistry. Regulation touches storage and shipping as well as sale.
  • Aircraft and drones, vehicles, and personal protective equipment. Separate licensing regimes with their own agencies, unrelated to ordinary product safety standards.
  • Lasers and other radiation-emitting products. Subject to federal performance standards and a reporting obligation.

The three-step early check

  1. Write your intended use in one sentence. Regulators respond to what you claim the product does, not what is inside it. The same optical sensor is a wellness gadget or a regulated device depending entirely on wording. Draft that sentence before anything else, and be honest about the marketing copy you will eventually want to use.
  2. Map your markets and channels. The US, EU, UK, and Canada run separate systems. Selling in one market only can cut your compliance cost substantially. Add your intended sales channel to the map, because retailer requirements can exceed legal ones.
  3. Identify the specific pathway. Not "is it regulated" but which standard, which agency, whose lab, what document at the end — a test report, a certificate, a listing, a clearance letter. The cost spread between these is enormous, and knowing which one applies converts an unknown into a line item.

Why the timing of this check matters so much

Regulation rarely kills a product. What it does is reshape timeline, budget, and sometimes the design itself: creepage distances on a PCB, a material change for biocompatibility, an enclosure that must resist ignition, a battery pack that needs protection circuitry, labeling that needs physical space. All of those are cheap decisions on a blank sheet and expensive ones after tooling exists.

Fold the check into your feasibility study and let it inform the test plan described in product safety testing requirements. A few hours of research at concept stage routinely saves a redesign later.

Practical ways to get an answer fast

  • Find a competing product already on the US market and look up its certifications and markings. Its compliance file is a roadmap to yours.
  • Search public agency databases for products with your intended use, and note the classification and route.
  • Call a testing laboratory. Reputable labs will scope your product informally and tell you which standards apply, at no charge, because it is how they win work.
  • Read the actual scope section of the candidate standard. Scopes are written to tell you whether you are in or out.
